Spouse of the Deceased

The surviving spouse of the deceased has the first right to bring a wrongful death claim. If you are the surviving spouse of the deceased, depending upon the circumstances, you may be eligible to bring a claim for wrongful death. 

Children of the Deceased:

If there is no surviving spouse, the deceased’s children may bring a wrongful death claim. If you are the surviving children of the deceased and there is no surviving spouse, depending upon the circumstances, you may be eligible to bring a claim for wrongful death.

Parents of the Deceased:

If there is no surviving spouse or children, the deceased’s parents may bring a wrongful death claim. If you are the surviving parents of the deceased and these conditions are met, depending upon the circumstances, you may be eligible to bring a claim for wrongful death.

Administrator of the Estate:

If there are no surviving family members, the administrator of the deceased’s estate may bring a wrongful death claim on behalf of the estate and any beneficiaries.  If you are the administrator of the deceased’s estate and these aforementioned conditions are met, depending upon the circumstances, you may be eligible to bring a claim for wrongful death.
